A South Florida appeals court handed NBA superstar Dwyane Wade a stunning blow earlier this week. The court’s ruled against Wade in his on going custody case with his ex-wife Siohvaughn Funches.
The ruling by the Third District Court of Appeals struck down Wade’s request to have his ex mentally evaluated and reduce the amount of time that she spends with their children.
Wade’s attorneys made the request for the mental evaluation based on a video and pictures that showed Funches sitting outside a Chicago courthouse protesting the court’s initial ruling. According to the lawyers she was mentally unstable and posed a danger to herself and others.
The judge presiding over the case ruled that Funches was simply “passionately voicing her views”
In another interesting turn in the case, the court also ordered the judge who presided over the case to be removed due to his denying Funches “the most basic right of due process” when he sided with Wade.
Lawyer Lisa Macci who represents Funches applauded the decision by the appeals court and claimed that the judge was too star struck to make an impartial decision…. Ouch!
Wade and his ex have been divorced for three years, and Wade has reportedly spent over $10 million fighting for custody of his two sons.
